1. Agreement to Terms

By downloading, installing, or using the Kilo app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding agreement between you and Kilo ("we," "us," or "our").

These Terms also serve as the End-User Licence Agreement (EULA) for the App as distributed through the Apple App Store. You acknowledge that this EULA is between you and Kilo only, and not with Apple Inc. Apple is not responsible for the App or its content.

2. Licence Grant

Subject to your compliance with these Terms, Kilo grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes.

The App is licensed to you, not sold. Kilo retains all ownership and intellectual property rights in the App. You receive no rights other than those expressly granted in these Terms.

You may not:

  • Copy, modify, or create derivative works of the App;
  • Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
  • Rent, lease, lend, sell, redistribute, or sublicense the App;
  • Remove, alter, or obscure any proprietary notices on the App;
  • Use the App for any unlawful purpose or in violation of these Terms.

3. Subscription & Free Trial

Certain features of Kilo require a paid subscription ("Kilo Premium"). The following terms apply to all subscriptions purchased through the Apple App Store:

  • Free trial: New subscribers receive a 3-day free trial of Kilo Premium. The trial begins on the date you subscribe and ends automatically after three (3) days.
  • Auto-renewal: At the end of the free trial, your subscription automatically renews at the then-current subscription price unless you cancel at least 24 hours before the end of the trial period. By subscribing, you authorise Apple to charge your App Store payment method for the renewal.
  • Subscription price: The current price is displayed on the subscription screen within the App and in the App Store listing before you subscribe. Prices may vary by region and are subject to change with advance notice.
  • Billing: Your App Store account is charged at confirmation of purchase and at the start of each renewal period.
  • Cancellation: You may cancel auto-renewal at any time through your Apple ID subscription settings (Settings → [Your Name] → Subscriptions on your iPhone). Cancelling stops future charges but does not refund any portion of the current billing period.
  • Refunds: All refund requests are handled by Apple in accordance with the App Store refund policy. Kilo has no ability to issue refunds directly.

Apple manages all billing and subscription management for purchases made through the App Store. For support with billing, visit support.apple.com/billing.

4. Health & Nutrition Disclaimer

Kilo is a general-purpose calorie and nutrition tracking tool. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • Calorie and macronutrient figures in the App are estimates based on available nutritional data and are not guaranteed to be accurate for every food preparation or individual.
  • Personalised calorie targets calculated by the App (using the Mifflin-St Jeor equation) are estimates and may not be appropriate for all individuals.
  • Always consult a qualified healthcare professional before starting any diet, nutrition plan, or weight-management programme, especially if you have or suspect you have a medical condition.
  • Do not rely solely on information from the App to make decisions about your health, diet, or medical treatment.

5. Acceptable Use

You agree to use the App only for lawful purposes. You must not:

  • Use the App in any way that violates applicable Saudi or international laws or regulations;
  • Upload or transmit any content that is unlawful, harmful, defamatory, or otherwise objectionable;
  • Attempt to gain unauthorised access to any part of the App, its servers, or related systems;
  • Use automated tools (bots, scrapers) to access or extract data from the App or its food database;
  • Interfere with or disrupt the integrity or performance of the App or the data it contains.

6. Intellectual Property

The App, its original content (including the Saudi food database, calorie data, design, and code), features, and functionality are owned by Kilo and are protected by applicable intellectual property laws. The Kilo name, logo, and associated marks are trademarks of Kilo. Nothing in these Terms grants you any right to use Kilo trademarks without prior written consent.

7. Your Data

You retain ownership of the food logs and personal data you enter into the App. By using the App, you grant Kilo a limited licence to store and process that data solely to provide the service to you, as described in our Privacy Policy. We do not sell your personal data.

8. Termination

We may suspend or terminate your access to the App immediately, without prior notice, if we determine that you have violated these Terms. Upon termination, your licence to use the App ceases immediately. You may also stop using the App and delete it at any time. Sections 4, 6, 9, and 10 survive any termination.

9. Disclaimers & Limitation of Liability

The App is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Kilo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App, including but not limited to loss of data, loss of profits, or personal injury resulting from reliance on App content.

In no event shall Kilo's total liability to you exceed the amount you paid for Kilo Premium in the twelve (12) months immediately preceding the claim, or SAR 50, whichever is greater.

You acknowledge that Apple has no warranty obligation whatsoever with respect to the App. Any maintenance, support, and warranty claims relating to the App are the sole responsibility of Kilo.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia.

11. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that — upon your acceptance of these Terms — Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, where the changes are material, notify you within the App or by email. Your continued use of the App after the effective date constitutes your acceptance of the updated Terms.
